The Messenger of Allah ﷺ said, "Learn the Quran and teach it to others, learn knowledge and teach it to others, and learn the religious obligations (Fara'id) and teach them to others. Verily, I am a person who will be taken, and knowledge will decrease until there will be disputes between two individuals regarding a religious obligation, and there will be no judge to settle their dispute."

أَخْبَرَنِي مُحَمَّدُ بْنُ إِسْمَاعِيلَ بْنِ إِبْرَاهِيمَ ابْنِ عُلَيَّةَ قَالَ حَدَّثَنَا إِسْحَاقُ بْنُ عِيسَى يَعْنِي الطَّبَّاعَ قَالَ حَدَّثَنَا شَرِيكٌ عَنْ عَوْفٍ يَعْنِي الْأَعْرَابِيَّ عَنْ سُلَيْمَانَ بْنِ جَابِرٍ عَنْ عَبْدِ اللهِ بْنِ مَسْعُودٍ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «تَعَلَّمُوا الْقُرْآنَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْعِلْمَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهَا النَّاسَ فَإِنِّي امْرُؤٌ مَقْبُوضٌ وَإِنَّ الْعِلْمَ سَيَنْقُصُ حَتَّى يَخْتَلِفَ الِاثْنَانِ فِي الْفَرِيضَةِ فَلَا يَجِدَانِ مَنْ يَفْصِلُ بَيْنَهُمَا»

Abdullah bin Mas'ood said: "Indeed, the Messenger of Allah ﷺ said, 'Learn the Quran and teach it to the people, learn and teach the obligations (i.e. religious duties), and learn knowledge and teach it to the people. For indeed, I am taking hold of you, and indeed, knowledge will decrease. And trials will appear until two people will differ in a matter of obligation, and they will not find anyone to judge between them.'"

أَخْبَرَنَا أَبُو إِسْحَاقَ إِبْرَاهِيمُ الْخَلَّالُ الْمَرْوَزِيُّ قَالَ أَخْبَرَنَا عَبْدُ اللهِ يَعْنِي ابْنَ الْمُبَارَكِ قَالَ أَخْبَرَنَا عَوْفٌ قَالَ بَلَغَنِي عَنْ سُلَيْمَانَ بْنِ جَابِرٍ قَالَ

قَالَ عَبْدُ اللهِ بْنُ مَسْعُودٍ إِنَّ رَسُولَ اللهِ ﷺ قَالَ «تَعَلَّمُوا الْقُرْآنَ وَعَلِّمُوهُ النَّاسَ وَتَعَلَّمُوا الْفَرَائِضَ وَعَلِّمُوهَا النَّاسَ وَتَعَلَّمُوا الْعِلْمَ وَعَلِّمُوهُ النَّاسَ فَإِنِّي مَقْبُوضٌ وَإِنَّ الْعِلْمَ سَيَنْقُصُ وَتَظْهَرُ الْفِتَنُ حَتَّى يَخْتَلِفَ الِاثْنَانِ فِي فَرِيضَةٍ لَا يَجِدَانِ إِنْسَانًا يَفْصِلُ بَيْنَهُمَا»

The Messenger of Allah ﷺ said, "We do not inherit what we leave behind, it is a charity." He said to Abdullah bin Rahman, Talha, Saad, and Ali, "I swear by Allah, you know that the Messenger of Allah ﷺ said, 'We do not inherit what we leave behind, it is a charity?' They said, 'Yes.'"

أَخْبَرَنِي هِلَالُ بْنُ الْعَلَاءِ بْنِ هِلَالٍ الرَّقِّيُّ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ حَاتِمٍ يَعْنِي وَهُوَ الْجَرْجَرَائِيُّ قَالَ حَدَّثَنَا ابْنُ الْمُبَارَكِ عَنْ مَعْمَرٍ وَيُونُسَ عَنِ الزُّهْرِيِّ عَنْ مَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ عَنْ عُمَرَ بْنِ الْخَطَّابِ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ» قَالَ وَقَالَ لِعَبْدِ الرَّحْمَنِ وَطَلْحَةَ وَسَعْدٍ وَعَلِيٍّ نَشَدْتُكُمْ بِاللهِ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ؟ قَالُوا نَعَمْ

" We do not have any heirs; what we leave behind is a charitable endowment."

أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ الرُّهَاوِيُّ قَالَ حَدَّثَنَا يَحْيَى بْنُ آدَمَ قَالَ حَدَّثَنَا ابْنُ عُيَيْنَةَ عَنْ مَعْمَرٍ وَعَمْرِو بْنِ دِينَارٍ عَنِ الزُّهْرِيِّ عَنْ مَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ عَنْ عُمَرَ

عَنِ النَّبِيِّ ﷺ قَالَ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ» يَعْنِي بِذَلِكَ نَفْسَهُ

Umar said to Abdur Rahman, Saad, Uthman, Talha, and Zubair, "I implore you by Allah, before whom the heavens and the earth stand, have you heard the Prophet ﷺ saying, 'We, the prophets, do not leave behind any inheritance. Whatever we leave behind is considered charity'?" They replied, "O Allah, yes."

أَخْبَرَنَا مُحَمَّدُ بْنُ مَنْصُورٍ الْمَكِّيُّ عَنْ سُفْيَانَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنِ الزُّهْرِيِّ عَنْ مَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ قَالَ

قَالَ عُمَرُ لِعَبْدِ الرَّحْمَنِ وَسَعْدٍ وَعُثْمَانَ وَطَلْحَةَ وَالزُّبَيْرِ أَنْشُدُكُمْ بِاللهِ الَّذِي قَامَتْ لَهُ السَّمَوَاتُ وَالْأَرْضُ سَمِعْتُمُ النَّبِيَّ ﷺ يَقُولُ «إِنَّا مَعْشَرَ الْأَنْبِيَاءِ لَا نُورَثُ مَا تَرَكْنَا فَهُوَ صَدَقَةٌ»؟ قَالُوا اللهُمَّ نَعَمْ

'Umar sent for me when the day rose high. I found him sitting on a couch without cover. When I entered upon him, he said: Malik, some people of you tribe gradually came here, and I have ordered to give them something, so distribute it among them. I said: If you assigned this (work) to some other person, (it would be better). He said: Take it. Then Yarfa' came to him and said: Commander of the Faithful, will you permit 'Uthman b. 'Affan, 'Abd al-Rahman b. 'Awf, al-Zubair b. al-'Awwam, and Sa'd b, Abi Waqqas (to enter) ? He said: Yes. So he permitted them and they entered. Yarfa' again came to him and said: Commander of the Faithful, would you permit al-'Abbas and 'Ali ? He said: Yes. He then permitted them and they entered. Al-'Abbas said: Commander of Faithful, decide between me and this, referring to 'Ali. Some of them said: Yes, Commander of the Faithful, decide between them and give them comfort. Malik b. Aws said: It occurred to me that both of them brought the other people for this. 'Umar said: Show patience (do not make haste). He then turned towards those people and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that Messenger of Allah ﷺ said: We are not inherited whatever we leave is sadaqah (alms). They said: Yes. He then turned towards 'Ali and al-'Abbas and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that Messenger of Allah ﷺ said: We are not inherited whatever we leave is sadaqah (alms). They said: Yes. He then said: Allah has appointed for the Messenger of Allah ﷺ a special portion (in the booty) which he did not do for anyone. Allah, Most High, said: What Allah has bestowed on His Apostle (and taken away) from them - for this ye made no expedition with either cavalry or camelry. But Allah gives power to His apostles over any He pleases ; and Allah has power over all things". Allah bestowed (the property of) Banu al-Nadir on His Apostle. I swear by Allah, he did not reserve it for himself, nor did he take it over and above you. The Messenger of Allah ﷺ used to his share for his maintenance annually, or used to take his contribution and give his family their annual contribution (from this property), then take what remained and deal with it as he did with Allah's property. He then turned towards those people and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that ? They said: Yes. He then turned towards 'Ali and al-'Abbas and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that ? They said: Yes. When the Messenger of Allah ﷺ died, Abu Bakr said: I am the protector of the Messenger of Allah ﷺ. Then you and this ('Ali) came to Abu Bakr, demanding a share from the inheritance of your cousin, and this ('Ali) demanding the share of his wife from (the property of her) father. Abu Bakr then said: The Messenger of Allah ﷺ said: We are not inherited. Whatever we leave is sadaqah. Allah knows that he (Abu Bakr) was true, faithful, rightly-guided, and the follower of Triuth. Abu Bakr then administered it (property of the Prophet). When Abu Bakr died, I said: I am the protector of the Messenger of Allah ﷺ and Abu Bakr. So I administered whatever Allah wished. Then you and this ('Ali) came. Both of you are at one, and your matter is the same. So they asked me for it (property), and I said: If you wish I give it to you on condition that you are bound by the covenant of Allah, meaning that you will administer it as the Messenger of Allah ﷺ used to administer. So you took it from me on that condition. Then again you have come to me so that I decide between you other than that. I swear by Allah, I shall not decide between you other than that till the Last Hour comes. If you helpless, return it to me. Abu Dawud said: They asked him for making it half between them, and not that they were ignorant of the fact the Prophet ﷺ said: We are not inherited. Whatever we leave is sadaqah (alms). They were also seeking the truth. 'Umar then said: I do not apply the name of division to it ; It leave it on its former condition.

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ أَبُو حَفْصٍ قَالَ حَدَّثَنِي بِشْرُ بْنُ عُمَرَ بْنِ الْحَكَمِ وَهُوَ الزَّهْرَانِيُّ قَالَ حَدَّثَنَا مَالِكٌ عَنِ الزُّهْرِيِّ عَنْ مَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ قَالَ أَرْسَلَ إِلَيَّ عُمَرُ حِينَ تَعَالَى النَّهَارُ فَجِئْتُهُ فَوَجَدْتُهُ جَالِسًا عَلَى سَرِيرٍ مُفْضِيًا إِلَى رِمَالِهِ فَقَالَ

حِينَ دَخَلْتُ عَلَيْهِ يَا مَالِكُ إِنَّهُ قَدْ دَقَّ أَهْلُ أَبْيَاتٍ وَقَدْ أَمَرْتُ فِيهِمْ بِرَضْخٍ فَخُذْهُ فَاقْسِمْ بَيْنَهُمْ قُلْتُ لَوْ أَمَرْتَ بِهِ غَيْرِي؟ ‍قَالَ خُذْهُ فَجَاءَ يَرْفَأُ قَالَ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ لَكَ فِي عُثْمَانَ وَعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ وَالزُّبَيْرِ بْنِ الْعَوَّامِ وَسَعْدِ بْنِ أَبِي وَقَّاصٍ؟ قَالَ نَعَمْ فَأَذِنَ لَهُمْ فَدَخَلُوا ثُمَّ جَاءَ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ لَكَ فِي الْعَبَّاسِ وَعَلِيٍّ؟ قَالَ نَعَمْ فَأَذِنَ لَهُمَا فَدَخَلَا فَقَالَ الْعَبَّاسُ يَا أَمِيرَ الْمُؤْمِنِينَ اقْضِ بَيْنِي وَبَيْنَ هَذَا يَعْنِي عَلِيًّا فَقَالَ بَعْضُهُمْ أَجَلْ يَا أَمِيرَ الْمُؤْمِنِينَ فَاقْضِ بَيْنَهُمَا وَارْحَمْهُمَا فَقَالَ عُمَرُ أَنْشُدُكُمْ ثُمَّ أَقْبَلَ عَلَى أُولَئِكَ الرَّهْطِ فَقَالَ أَنْشُدُكُمْ بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ؟» قَالُوا نَعَمْ ثُمَّ أَقْبَلَ عَلَى عَلِيٍّ وَالْعَبَّاسِ فَقَالَ أَنْشُدُكُمَا بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ ؟ قَالَا نَعَمْ قَالَ فَإِنَّ اللهَ خَصَّ نَبِيَّهُ ﷺ بِخَاصَّةٍ لَمْ يَخُصَّ بِهَا أَحَدًا مِنَ النَّاسِ فَقَالَ {وَمَا أَفَاءَ اللهُ عَلَى رَسُولِهِ مِنْهُمْ فَمَا أَوْجَفْتُمْ عَلَيْهِ مِنْ خَيْلٍ وَلَا رِكَابٍ وَلَكِنَّ اللهَ يُسَلَّطُ رُسُلَهُ عَلَى مَنْ يَشَاءُ وَاللهُ عَلَى كُلِّ شَيْءٍ قَدِيرٌ} [الحشر 6] فَكَانَ اللهُ أَفَاءَ عَلَى رَسُولِهِ ﷺ بَنِي النَّضِيرِ فَوَاللهِ مَا اسْتَأْثَرَ بِهَا عَلَيْكُمْ وَلَا أَخَذَهَا دُونَكُمْ فَكَانَ رَسُولُ اللهِ ﷺ يَأْخُذُ مِنْهَا نَفَقَةَ سَنَةٍ وَيَجْعَلُ مَا بَقِيَ أُسْوَةَ الْمَالِ ثُمَّ أَقْبَلَ عَلَى أُولَئِكَ الرَّهْطِ فَقَالَ أَنْشُدُكُمْ بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمُونَ ذَلِكَ؟ قَالُوا نَعَمْ وَأَقْبَلَ عَلَى عَلِيٍّ وَالْعَبَّاسِ فَقَالَ أَنْشُدُكُمَا بِاللهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالْأَرْضُ هَلْ تَعْلَمَانِ ذَلِكَ؟ قَالَا نَعَمْ فَلَمَّا تُوُفِّيَ رَسُولُ اللهِ ﷺ قَالَ أَبُو بَكْرٍ أَنَا وَلِيُّ رَسُولِ اللهِ ﷺ فَجِئْتَ أَنْتَ وَهَذَا إِلَى أَبِي بَكْرٍ فَجِئْتَ أَنْتَ تَطْلُبُ مِيرَاثَكَ مِنِ ابْنِ أَخِيكَ وَيَطْلُبُ هَذَا مِيرَاثَ امْرَأَتِهِ مِنْ أَبِيهَا فَقَالَ أَبُو بَكْرٍ قَالَ رَسُولُ اللهِ ﷺ «لَا نُورَثُ مَا تَرَكْنَا صَدَقَةٌ» فَوَلِيَهَا أَبُو بَكْرٍ فَلَمَّا تُوُفِّيَ قُلْتُ أَنَا وَلِيُّ رَسُولِ اللهِ ﷺ وَوَلِيُّ أَبِي بَكْرٍ فَوَلِيتُهَا مَا شَاءَ اللهُ أَنْ أَلِيَهَا ثُمَّ جِئْتَ أَنْتَ وَهَذَا وَأَنْتُمَا جَمِيعًا وَأَمْرُكُمَا وَاحِدٌ فَسَأَلْتُمَانِيهَا فَقُلْتُ إِنْ شِئْتُمَا أَدْفَعَهَا إِلَيْكُمَا عَلَى أَنَّ عَلَيْكُمَا عَهْدَ اللهِ لِتَلِيَانَهَا بِالَّذِي كَانَ رَسُولُ اللهِ ﷺ يَلِيهَا بِهِ فَأَخَذْتُمَاهَا مِنِّي عَلَى ذَلِكَ ثُمَّ جِئْتُمَانِي لِأَقْضِيَ بَيْنَكُمَا بِغَيْرِ ذَلِكَ وَاللهِ لَا أَقْضِي بَيْنَكُمَا بِغَيْرِ ذَلِكَ حَتَّى تَقُومَ السَّاعَةُ فَإِنْ عَجَزْتُمَا عَنْهَا فَرُدَّاهَا إِلَيَّ

Qutaybah b. Saʿīd > Mālik > Ibn Shihāb > ʿUrwah > ʿĀʾishah

When the Messenger of Allah ﷺ died, the wives of the Prophet ﷺ intended to send 'Uthman b. 'Affan to Abu Bakr to ask him their cost of living from (the inheritance of) the Prophet ﷺ. Thereupon 'Aishah said: Did not the Messenger of Allah ﷺ say: We are not inherited. Whatever we leave is sadaqah.

أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ عَنْ عُرْوَةَ عَنْ عَائِشَةَ

أَنَّ أَزْوَاجَ النَّبِيِّ ﷺ حِينَ تُوُفِّيَ رَسُولُ اللهِ ﷺ أَرَدْنَ أَنْ يَبْعَثْنَ عُثْمَانَ بْنَ عَفَّانَ إِلَى أَبِي بَكْرٍ؛ يَسْأَلْنَ مِيرَاثَهُنَّ مِنْ رَسُولِ اللهِ ﷺ فَقَالَتْ لَهُنَّ عَائِشَةُ أَلَيْسَ قَدْ قَالَ رَسُولُ اللهِ ﷺ «لَا نُورَثُ مَا تَرَكْنَا فَهُوَ صَدَقَةٌ»

Muḥammad b. ʿAbd al-Aʿlá al-Ṣanʿānī > Yazīd / Ibn Zurayʿ > Ḥajjāj al-Aḥwal > Salamah b. Junādah > Sinān b. Salamah

A man from the immigrants donated a large piece of land to his mother, but she passed away and he had no other heir except himself. He came to the Prophet ﷺ and said, "My mother was one of the dearest people to me and I honored her. I donated a large piece of land to her, but she passed away and I am her only heir. How should I deal with it?" The Prophet ﷺ said, "Allah has made your reward obligatory and has returned your land to you. So, do with it as you please."

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ الْأَعْلَى الصَّنْعَانِيُّ قَالَ حَدَّثَنَا يَزِيدُ وَهُوَ ابْنُ زُرَيْعٍ قَالَ حَدَّثَنَا حَجَّاجٌ الْأَحْوَلُ قَالَ حَدَّثَنَا سَلَمَةُ بْنُ جُنَادَةَ عَنْ سِنَانِ بْنِ سَلَمَةَ

أَنَّ رَجُلًا مِنَ الْمُهَاجِرِينَ تَصَدَّقَ بِأَرْضٍ لَهُ عَظِيمَةٍ عَلَى أُمِّهِ فَمَاتَتْ وَلَيْسَ لَهَا وَارِثٌ غَيْرُهُ فَأَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّ أُمِّي كَانَتْ مِنْ أَحَبِّ النَّاسِ إِلَيَّ وَأَعَزَّهَمْ عَلَيَّ وَإِنِّي تَصَدَّقْتُ عَلَيْهَا بِأَرْضٍ لِي عَظِيمَةٍ فَمَاتَتْ وَلَيْسَ لَهَا وَارِثٌ غَيْرِي فَكَيْفَ تَأْمُرُنِي أَنْ أَصْنَعَ بِهَا؟ قَالَ قَدْ أَوْجَبَ اللهُ لَكَ أَجْرَكَ وَرَدَّ عَلَيْكَ أَرْضَكَ فَاصْنَعْ بِهَا كَيْفَ شِئْتَ

Yūnus b. ʿAbd al-Aʿlá al-Miṣrī > Ibn Wahb > ʿAmr b. al-Ḥārith > Saʿīd b. Abū Hilāl > Abū Bakr b. Ḥazm > ʿAbdullāh b. Zayd b. ʿAbd Rabbih al--Adhī Urī al-Nidāʾ

"That he gave charity to his parents, then both of them passed away, so the Messenger of Allah ﷺ returned his share of inheritance to him."

أَخْبَرَنَا يُونُسُ بْنُ عَبْدِ الْأَعْلَى الْمِصْرِيُّ قَالَ حَدَّثَنَا ابْنُ وَهْبٍ قَالَ أَخْبَرَنِي عَمْرُو بْنُ الْحَارِثِ عَنْ سَعِيدِ بْنِ أَبِي هِلَالٍ عَنْ أَبِي بَكْرِ بْنِ حَزْمٍ عَنْ عَبْدِ اللهِ بْنِ زَيْدِ بْنِ عَبْدِ رَبِّهِ الَّذِي أُرِيَ النِّدَاءَ

«أَنَّهُ تَصَدَّقَ عَلَى أَبَوَيْهِ ثُمَّ تُوُفِّيَا فَرَدَّهُ رَسُولُ اللهِ ﷺ إِلَيْهِ مِيرَاثًا»

"A woman came to the Prophet ﷺ and said, 'I have given charity on behalf of my mother with a young slave girl, but she has passed away. So, she has come to me as an inheritance.' He (the Prophet) said, 'Allah has rewarded you and honored you with inheritance.' Abu Abdullah Al-Rahman said, 'This is incorrect, and the correct wording is Abdullah ibn Buraida.'"

أَخْبَرَنَا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ الْأَذْرَمِيُّ وَعَبْدُ الرَّحْمَنِ بْنُ مُحَمَّدِ بْنِ سَلَّامٍ الطَّرَسُوسِيُّ وَاللَّفْظُ لَهُ قَالَ حَدَّثَنَا إِسْحَاقُ الْأَزْرَقُ قَالَ حَدَّثَنَا عَبْدُ الْمَلِكِ بْنُ أَبِي سُلَيْمَانَ عَنْ عَبْدِ اللهِ بْنِ عَطَاءٍ عَنْ سُلَيْمَانَ بْنِ بُرَيْدَةَ عَنْ أَبِيهِ

أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنِّي تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ فَمَاتَتْ فَرَجَعَتْ إِلَيَّ فِي الْمِيرَاثِ فَقَالَ «قَدْ آجَرَكِ اللهُ وَرَدَّ عَلَيْكِ فِي الْمِيرَاثِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا خَطَأٌ وَالصَّوَابُ عَبْدُ اللهِ بْنُ بُرَيْدَةَ

Buraidah said A woman came to the Messenger of Allah ﷺ and said I gave a slave girl as sadaqah to my mother who has now died and has left that slave girl. He said your reward is sure and the inheritance has given her back to you.

أَخْبَرَنَا عَبْدَةُ بْنُ عَبْدِ اللهِ الْبَصْرِيُّ عَنْ سُوَيْدٍ وَهُوَ ابْنُ عَمْرٍو الْكَلْبِيُّ عَنْ زُهَيْرٌ وَهُوَ ابْنُ مُعَاوِيَةَ وَأَخْبَرَنِي هِلَالُ بْنُ الْعَلَاءِ بْنِ هِلَالٍ قَالَ حَدَّثَنَا حُسَيْنُ بْنُ عَيَّاشٍ الْبَاجَدَّائِيُّ قَالَ حَدَّثَنَا زُهَيْرٌ قَالَ حَدَّثَنَا عَبْدُ اللهِ بْنُ عَطَاءٍ عَنْ عَبْدِ اللهِ بْنِ بُرَيْدَةَ عَنْ أَبِيهِ

أَنَّ امْرَأَةً أَتَتْ رَسُولَ اللهِ ﷺ فَقَالَتْ إِنِّي كُنْتُ تَصَدَّقْتُ عَلَى أُمِّي بِوَلِيدَةٍ وَإِنَّهَا مَاتَتْ وَتَرَكَتْ تِلْكَ الْوَلِيدَةَ فَقَالَ «وَجَبَ أَجْرُكِ وَرَجَعَتْ إِلَيْكِ فِي الْمِيرَاثِ»

Yaʿqūb b. Ibrāhīm al-Dawraqī > Yaḥyá / Ibn Saʿīd al-Qaṭṭān > al-Jaʿd / Ibn Aws > ʿĀʾishah b. Saʿd

I became seriously ill at Mecca and the Prophet ﷺ came to visit me. I said, "O Messenger of Allah ﷺ! I shall leave behind me a good fortune, but my heir is my only daughter; shall I bequeath two third of my property to be spent in charity and leave one third (for my heir)?" He said, "No." I said, "Shall I bequeath half and leave half?" He said, "No." I said, "Shall I bequeath one third and leave two thirds?" He said, "One third is alright, though even one third is too much." Then he placed his hand on his forehead and passed it over my face and ʿAbdomen and said, "O Allah! Cure Saʿd and complete his emigration." I feel as if I have been feeling the coldness of his hand on my liver ever since.

أَخْبَرَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الدَّوْرَقِيُّ قَالَ حَدَّثَنَا يَحْيَى يَعْنِي ابْنَ سَعِيدٍ الْقَطَّانَ عَنِ الْجَعْدِ يَعْنِي ابْنَ أَوْسٍ قَالَ حَدَّثَتْنِي عَائِشَةُ بِنْتُ سَعْدٍ قَالَتْ

قَالَ سَعْدٌ اشْتَكَيْتُ شَكْوَى بِمَكَّةَ فَدَخَلَ عَلَى رَسُولِ اللهِ ﷺ يَعُودُنِي قُلْتُ يَا رَسُولَ اللهِ إِنِّي تَرَكْتُ مَالًا وَلَيْسَ عِنْدِي إِلَّا ابْنَةٌ وَاحِدَةٌ أَفَأَوْصِي بِثُلُثَيْ مَالِي فَأَتْرُكُ لَهَا الثُّلُثَ؟ قَالَ «لَا» قُلْتُ فَأَوْصِي بِالنِّصْفِ فَأَتْرُكُ لَهَا النِّصْفَ؟ قَالَ «لَا» قُلْتُ فَأَوْصِي بِالثُّلُثِ وَأَتْرُكُ لَهَا الثُّلُثَيْنِ؟ قَالَ «الثُّلُثُ وَالثُّلُثُ كَبِيرٌ» ثَلَاثَ مَرَّاتٍ وَوَضَعَ يَدَهُ عَلَى جَبْهَتِي فَمَسَحَ وَجْهِي وَصَدْرِي وَبَطْنِي قَالَ اللهُمَّ اشْفِ سَعْدًا وَأَتِمَّ لَهُ هِجْرَتَهُ فَمَا زِلْتُ أَجِدُ بَرْدَ يَدِهِ عَلَى كَبِدِي حَتَّى السَّاعَةِ

ʿAmr b. ʿAlī al-Fallās > ʿAbd al-Raḥman / Ibn Mahdī > Sufyān / al-Thawrī > Saʿd b. Ibrāhīm > ʿĀmir b. Saʿd from his father

"The Prophet came to visit me when I was in Makkah. I said: 'O Messenger of Allah, shall I bequeath all my money?' He said: 'No.' I said: 'One-half?' He said: 'No.' I said: 'One-third?' He said: '(Bequeath) one-third, and one-third is a lot. If you leave your heirs independent of means, that is better than if you leave them poor and holding out their hands to people.'"

أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ الْفَلَّاسُ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ يَعْنِي ابْنَ مَهْدِيٍّ قَالَ حَدَّثَنَا سُفْيَانُ يَعْنِي الثَّوْرِيَّ عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ عَنْ عَامِرِ بْنِ سَعْدٍ عَنْ أَبِيهِ قَالَ

كَانَ النَّبِيُّ ﷺ يَعُودُهُ وَهُوَ بِمَكَّةَ وَلَمْ تَكُنْ لَهُ إِلَّا ابْنَةٌ وَاحِدَةٌ قَالَ يَا رَسُولَ اللهِ أُوصِي بِمَالِي كُلِّهِ؟ قَالَ «لَا» قَالَ النِّصْفُ؟ قَالَ «لَا» قَالَ فَالثُّلُثُ؟ قَالَ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَدَعْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ فِي أَيْدِيهِمْ

Mūsá b. ʿAbd al-Raḥman al-Masrūqī > Abū Usāmah / Ḥammād b. Usāmah > Ḥusayn / al-Muʿallim > ʿAmr b. Shuʿayb from his father from his grandfather

A man gave a piece of land to his son as a charity, but then it was returned to him as inheritance. He mentioned this to the Messenger of Allah ﷺ , who said to him, "You have earned a reward, and your property has returned to you."

أَخْبَرَنَا مُوسَى بْنُ عَبْدِ الرَّحْمَنِ الْمَسْرُوقِيُّ عَنْ أَبِي أُسَامَةَ يَعْنِي حَمَّادَ بْنَ أُسَامَةَ عَنْ حُسَيْنٍ يَعْنِي الْمُعَلِّمَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ

أَنَّ رَجُلًا تَصَدَّقَ عَلَى وَلَدِهِ بِأَرْضٍ فَرَدَّهَا إِلَيْهِ الْمِيرَاثُ فَذَكَرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَقَالَ لَهُ «وَجَبَ أَجْرُكَ وَرَجَعَ إِلَيْكَ مَالُكَ»

The Messenger of Allah ﷺ used to frequently perform ablution without any clear reason, so he poured water from his ablution onto me. Then he became conscious and I asked him if it meant that he was bequeathing me some inheritance. So, the verse of obligatory bequest was revealed.

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ الْأَعْلَى الصَّنْعَانِيُّ قَالَ حَدَّثَنَا خَالِدٌ يَعْنِي ابْنَ الْحَارِثِ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ عَنْ جَابِرٍ

أَنَّ رَسُولَ اللهِ ﷺ عَادَهُ وَهُوَ لَا يَعْقِلُ فَتَوَضَّأَ فَصَبَّ عَلَيْهِ مِنْ وَضُوئِهِ فَعَقَلَ قُلْتُ يَرِثُنِي كَلَالَةٌ فَكَيْفَ الْمِيرَاثُ؟ فَأُنْزِلَ آيَةُ الْفَرْضِ

I became sick so Messenger of Allah ﷺ and Abu Bakr came on foot to pay me a visit. When they came, I was unconscious. Messenger of Allah ﷺ performed ablution and he poured over me the water (of his ablution) and I came to my senses and said, "O Messenger of Allah ﷺ! What shall I do regarding my property? How shall I distribute it?" The Prophet ﷺ did not reply till the Divine Verses of inheritance were revealed .

أَخْبَرَنَا مُحَمَّدُ بْنُ مَنْصُورٍ الْمَكِّيُّ عَنْ سُفْيَانَ يَعْنِي ابْنَ عُيَيْنَةَ قَالَ سَمِعْتُ ابْنَ الْمُنْكَدِرِ يَقُولُ

سَمِعْتُ جَابِرًا يَقُولُ مَرِضْتُ فَأَتَانِي رَسُولُ اللهِ ﷺ وَأَبُو بَكْرٍ يَعُودَانِي وَهُمَا يَمْشِيَانِ فَوَجَدَانِي قَدْ أُغْمِيَ عَلَيَّ فَتَوَضَّأَ رَسُولُ اللهِ ﷺ فَصَبَّ وَضُوءَهُ عَلَيَّ فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللهِ كَيْفَ أَقْضِي فِي مَالِي؟ كَيْفَ أَصْنَعُ فِي مَالِي؟ فَلَمْ يُجِبْنِي بِشَيْءٍ حَتَّى أُنْزِلَتْ آيَةُ الْمِيرَاثِ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176] قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ ابْنُ جُرَيْجٍ

Allah's Apostle ﷺ and Abi Bakr (Allah be pleased with him) visited me on foot in Banu Salama, and found me unconscious. He (the Holy Prophet) called for water and performed ablution and sprinkled out of it (the water) over me. I felt relieved. I said: Messenger of Allah, what should I do with my property? And this verse was revealed:" Allah enjoins you concerning your children: for the male is equal of the portion of two females."

أَخْبَرَنَا الْحَسَنُ بْنُ مُحَمَّدٍ الزَّعْفَرَانِيُّ قَالَ حَدَّثَنَا حَجَّاجٌ يَعْنِي ابْنَ مُحَمَّدٍ الْأَعْوَرَ عَنِ ابْنِ جُرَيْجٍ قَالَ أَخْبَرَنِي ابْنُ الْمُنْكَدِرِ عَنْ جَابِرٍ قَالَ

عَادَنِي النَّبِيُّ ﷺ وَأَبُو بَكْرٍ فِي بَنِي سَلَمَةَ فَوَجَدَانِي لَا أَعْقِلُ فَدَعَا بِمَاءٍ فَتَوَضَّأَ ثُمَّ رَشَّ عَلَيَّ مِنْهُ فَأَفَقْتُ فَقُلْتُ لَهُ كَيْفَ أَصْنَعُ فِي مَالِي يَا رَسُولَ اللهِ؟ فَأَنْزَلَ اللهُ {يُوصِيكُمُ اللهُ فِي أَوْلَادِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء 11]

Jabir used to say: This verse was revealed about me: "They ask thee for a legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs.

أَخْبَرَنَا إِسْمَاعِيلُ بْنُ مَسْعُودٍ الْجَحْدَرِيُّ قَالَ حَدَّثَنَا خَالِدٌ يَعْنِي ابْنَ الْحَارِثِ قَالَ حَدَّثَنَا هِشَامٌ يَعْنِي ابْنَ أَبِي عَبْدِ اللهِ الدَّسْتُوَائِيَّ وَهُوَ هِشَامُ بْنُ سَنْبَرٍ قَالَ حَدَّثَنَا أَبُو الزُّبَيْرِ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ قَالَ

اشْتَكَيْتُ وَعِنْدِي سَبْعُ أَخَوَاتٍ لِي فَدَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ فَنَفَخَ فِي وَجْهِي فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللهِ أَلَا أُوصِي لِأَخَوَاتِي بِالثُّلُثَيْنِ؟ ثُمَّ خَرَجَ وَتَرَكَنِي ثُمَّ رَجَعَ إِلَيَّ فَقَالَ إِنِّي لَا أَرَاكَ مَيِّتًا مِنْ وَجَعِكَ هَذَا وَإِنَّ اللهَ قَدْ أَنْزَلَ فَبَيَّنَ الَّذِي لِأَخَوَاتِكَ فَجَعَلَ لَهُنَّ الثُّلُثَيْنِ فَكَانَ جَابِرٌ يَقُولُ أُنْزِلَتْ هَذِهِ الْآيَةُ فِيَّ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176]

أَخْبَرَنِي مَسْعُودُ بْنُ جُوَيْرِيَةُ الْمَوْصِلِيُّ قَالَ حَدَّثَنَا الْمُعَافَى عَنْ هِشَامٍ صَاحِبِ الدَّسْتُوَائِيِّ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ قَالَ

اشْتَكَيْتُ وَعِنْدِي سَبْعُ أَخَوَاتٍ لِي فَدَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ فَنَضَحَ فِي وَجْهِي فَأَفَقْتُ فَقُلْتُ يَا رَسُولَ اللهِ أُوصِي لِأَخَوَاتِي بِالثُّلُثَيْنِ؟ قَالَ «أَحْسِنْ» قُلْتُ الشَّطْرُ؟ قَالَ «أَحْسِنْ» ثُمَّ خَرَجَ وَتَرَكَنِي ثُمَّ رَجَعَ فَقَالَ يَا جَابِرُ إِنِّي لَا أَرَاكَ مَيِّتًا مِنْ وَجَعِكَ هَذَا وَإِنَّ اللهَ قَدْ أَنْزَلَ فَبَيَّنَ لِأَخَوَاتِكَ فَجَعَلَ لَهُنَّ الثُّلُثَيْنِ قَالَ جَابِرٌ فَنَزَلَتْ هَذِهِ الْآيَةُ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176]

Yūsuf b. Ḥammād al-Maʿnī > Sufyān b. Ḥabīb And Shuʿbah > Abū Isḥāq > al-Barāʾ

The last verse revealed about the decease who left no descendants or ascendants: "They ask thee for the legal decision. Say: Allah directs (thus) about those who leave no descendants or ascendants as heirs."

أَخْبَرَنَا يُوسُفُ بْنُ حَمَّادٍ الْمَعْنِيُّ قَالَ حَدَّثَنَا سُفْيَانُ بْنُ حَبِيبٍ وَشُعْبَةُ عَنْ أَبِي إِسْحَاقَ عَنِ الْبَرَاءِ قَالَ

آخِرُ آيَةٍ نَزَلَتْ {يَسْتَفْتُونَكَ قُلِ اللهُ يُفْتِيكُمْ فِي الْكَلَالَةِ} [النساء 176]

The last verse revealed in the Quran is Surah An-Nisa.

أَخْبَرَنَا عَلِيُّ بْنُ حُجْرِ بْنِ إِيَاسِ بْنِ مُقَاتِلِ بْنِ مُشَمْرِجِ بْنِ خَالِدٍ السَّعْدِيُّ الْمَرْوَزِيُّ قَالَ حَدَّثَنَا سَعْدَانُ يَعْنِي ابْنَ يَحْيَى عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ عَنْ أَبِي إِسْحَاقَ عَنِ الْبَرَاءِ قَالَ

«آخِرُ آيَةٍ أُنْزِلَتْ فِي الْقُرْآنِ سُورَةُ النِّسَاءِ»

Rabīʿah al-Bāhilī Fasaʾalahumā > Āb.ah Wāb.ah Ibn Waʾukht Liʾab Waʾum > Liliāb.ah al-Niṣf Wamā Baqī Falilʾukht Wāʾt Ibn Masʿūd Faʾinnah Sayutābiʿunā Faʾatá al-a man Ibn Masʿūd Fasaʾalah Faʾakhbarah Bimā > Ibn Masʿūd Laqad Ḍalalt Idh Wamā

“A man came to Abu Musa Al-Ash’ari and Salman bin Rabi’ah Al-Bahili and asked them about (the shares of) a daughter, a son’s daughter, a sister through one’s father and mother. They said: ‘The daughter gets one half, and what is left goes to the sister. Go to Ibn Mas’ud, for he will concur with what we say.’ So the man went to Ibn Mas’ud, and told him what they had said. ‘Abdullah said: ‘I will go astray and will not be guided (if I say that I agree); but I will judge as the Messenger of Allah ﷺ judged. The daughter gets one half, and the son’s daughter gets one- sixth. That makes two thirds. And what is left goes to the sister.’”

أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلَانَ الْمَرْوَزِيُّ قَالَ حَدَّثَنَا وَكِيعٌ يَعْنِي ابْنَ الْجَرَّاحِ قَالَ حَدَّثَنَا سُفْيَانُ يَعْنِي الثَّوْرِيَّ عَنْ أَبِي قَيْسٍ وَاسْمُهُ عَبْدُ الرَّحْمَنِ بْنُ ثَرْوَانَ عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ قَالَ جَاءَ رَجُلٌ إِلَى أَبِي مُوسَى وَهُوَ الْأَمِيرُ وَسُفْيَانَ بْنِ رَبِيعَةَ الْبَاهِلِيِّ فَسَأَلَهُمَا عَنِ ابْنَةٍ وَابْنَةِ ابْنٍ وَأُخْتٍ لِأَبٍ وَأُمٍّ قَالَ لِلِابْنَةِ النِّصْفُ وَمَا بَقِيَ فَلِلْأُخْتِ وَائْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنَا فَأَتَى الرَّجُلُ ابْنَ مَسْعُودٍ فَسَأَلَهُ فَأَخْبَرَهُ بِمَا قَالَا فَقَالَ

ابْنُ مَسْعُودٍ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ وَلَكِنِّي سَأَقْضِي بِمَا قَضَى بِهِ رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ تَكْمِلَةَ الثُّلُثَيْنِ وَمَا بَقِيَ فَلِلْأُخْتِ

"For the daughter, it is half, and for the sister, it is half. Come to Abdullah and he will follow me. So Abdullah came and mentioned that to him. He said, 'I found in the book that I have gone astray, and I am not one of the guided ones. I will judge in it according to what the Messenger of Allah ﷺ has decreed: for the daughter, it is half, for the daughter of the son, it is one-sixth, and what remains is for the sister.' So he came to Abu Musa and mentioned that to him. He said, 'Do not ask me about anything as long as this ink is between your faces.'"

أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ الْأَعْلَى الصَّنْعَانِيُّ قَالَ حَدَّثَنَا خَالِدٌ يَعْنِي ابْنَ الْحَارِثِ قَالَ حَدَّثَنَا شُعْبَةُ قَالَ أَخْبَرَنِي أَبُو قَيْسٍ قَالَ سَمِعْتُ هُزَيْلًا يُحَدِّثُ أَنَّ رَجُلًا سَأَلَ أَبَا مُوسَى عَنِ امْرَأَةٍ تَرَكَتِ ابْنَتَهَا وَأُخْتَهَا وَابْنَةَ ابْنِهَا فَقَالَ

لِلِابْنَةِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ وَائْتِ عَبْدَ اللهِ فَسَيُتَابِعُنِي فَأَتَى عَبْدَ اللهِ فَذَكَرَ ذَلِكَ لَهُ قَالَ فَوَجَدْتُ فِي الْكِتَابِ لَقَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ أَقْضِي فِيهَا بِمَا قَضَى رَسُولُ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ وَمَا بَقِيَ فَلِلْأُخْتِ فَأَتَى أَبَا مُوسَى فَذَكَرَ ذَلِكَ لَهُ فَقَالَ لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ

Abu Musa was asked regarding (the inheritance of) a daughter, a son's daughter, and a sister. He said, "The daughter will take one-half and the sister will take one-half. If you go to Ibn Masʿud, he will tell you the same." Ibn Masʿud was asked and was told of Abu Musa's verdict. Ibn Masʿud then said, "If I give the same verdict, I would stray and would not be of the rightly-guided. The verdict I will give in this case, will be the same as the Prophet ﷺ did, i.e. one-half is for daughter, and one-sixth for the son's daughter, i.e. both shares make two-thirds of the total property; and the rest is for the sister." Afterwards we cams to Abu Musa and informed him of Ibn Masʿud's verdict, whereupon he said, "So, do not ask me for verdicts, as long as this learned man is among you."

أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ بُنْدَارٌ عَنْ مُحَمَّدٍ يَعْنِي غُنْدَرًا قَالَ حَدَّثَنَا شُعْبَةُ عَنْ أَبِي قَيْسٍ عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ قَالَ سَأَلَ رَجُلٌ أَبَا مُوسَى عَنِ امْرَأَةٍ تَرَكَتِ ابْنَتَهَا وَابْنَةَ ابْنِهَا وَأُخْتَهَا فَقَالَ لِلِابْنَةِ النِّصْفُ وَلِلْأُخْتِ النِّصْفُ وَائْتِ ابْنَ مَسْعُودٍ فَإِنَّهُ سَيُتَابِعُنِي فَأَتَوُا ابْنَ مَسْعُودٍ فَأَخْبَرُوهُ بِقَوْلِ أَبِي مُوسَى فَقَالَ

قَدْ ضَلَلْتُ إِذًا وَمَا أَنَا مِنَ الْمُهْتَدِينَ لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللهِ ﷺ لِلِابْنَةِ النِّصْفُ وَلِابْنَةِ الِابْنِ السُّدُسُ وَمَا بَقِيَ فَلِلْأُخْتِ فَأَتَوْا أَبَا مُوسَى فَأَخْبَرُوهُ فَقَالَ لَا تَسْأَلُونِي وَهَذَا الْحَبْرُ بَيْنَ أَظْهُرِكُمْ

The Prophet ﷺ said, "Give the Fara'id (the shares of the inheritance that are prescribed in the Qur'an) to those who are entitled to receive it. Then whatever remains, should be given to the closest male relative of the deceased ."

أَخْبَرَنَا مُحَمَّدُ بْنُ مَعْمَرٍ الْبَحْرَانِيُّ قَالَ حَدَّثَنَا حَبَّانُ يَعْنِي ابْنَ هِلَالٍ قَالَ حَدَّثَنَا وُهَيْبٌ يَعْنِي ابْنَ خَالِدٍ قَالَ حَدَّثَنَا ابْنُ طَاوُسٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ

أَنَّ النَّبِيَّ ﷺ قَالَ «أَلْحِقُوا الْفَرَائِضَ بِأَهْلِهَا فَمَا بَقِيَ فَهُوَ لِأَوْلَى رَجُلٍ ذَكَرٍ»

The Messenger of Allah ﷺ said, "Attach the wealth to the obligations, for whatever is left of the obligations is the rightful possession of the person who remembers." Abu Abdur-Rahman Sufyan Ath-Thawri said, "I have memorized more from Wahib, and Wahib is trustworthy and reliable. It is as if the narration of Ath-Thawri is more accurate."

أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ الرُّهَاوِيُّ قَالَ حَدَّثَنَا أَبُو دَاوُدَ يَعْنِي عُمَرَ بْنَ سَعْدٍ الْحَفَرِيَّ عَنْ سُفْيَانَ يَعْنِي الثَّوْرِيَّ عَنِ ابْنِ طَاوُسٍ عَنْ طَاوُسٍ قَالَ

قَالَ رَسُولُ اللهِ ﷺ «أَلْحِقُوا الْمَالَ بِالْفَرَائِضِ فَمَا تَرَكَتِ الْفَرَائِضُ فَأَوْلَى رَجُلٍ ذَكَرٍ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ سُفْيَانُ الثَّوْرِيُّ أَحْفَظُ مِنْ وُهَيْبٍ وَوُهَيْبٌ ثِقَةٌ مَأْمُونٌ وَكَأَنَّ حَدِيثَ الثَّوْرِيِّ أَشْبَهُ بِالصَّوَابِ

Sulaymān b. Salm al-Balkhī > al-Naḍr / Ibn Shumayl > Yūnus / Ibn Abū Isḥāq > Abū Isḥāq > ʿAmr b. Maymūn

That Umar gathered the companions of the Messenger of Allah, ﷺ , to discuss a matter pertaining to inheritance. He asked them if anyone had heard the Messenger of Allah, ﷺ , mention anything about inheritance. Maqil ibn Yasar Al-Muzani stood up and said, "I heard the Messenger of Allah, ﷺ , mention a duty that includes inheritance and he gave two-thirds or one-half of it." Umar asked him, "What is the duty?" He replied, "I do not know." Umar kicked him with his foot and said, "You don't know!"

أَخْبَرَنَا سُلَيْمَانُ بْنُ سَلْمٍ الْبَلْخِيُّ قَالَ أَخْبَرَنَا النَّضْرُ يَعْنِي ابْنَ شُمَيْلٍ قَالَ أَخْبَرَنَا يُونُسُ يَعْنِي ابْنَ أَبِي إِسْحَاقَ عَنْ أَبِي إِسْحَاقَ عَنْ عَمْرِو بْنِ مَيْمُونٍ

أَنَّ عُمَرَ جَمَعَ أَصْحَابَ رَسُولِ اللهِ ﷺ فِي شَأْنِ الْجَدِّ فَنَشَدَهُمْ مَنْ سَمِعَ رَسُولَ اللهِ ﷺ ذَكَرَ مِنَ الْجَدِّ شَيْئًا فَقَامَ مَعْقِلُ بْنُ يَسَارٍ الْمُزَنِيُّ فَقَالَ سَمِعْتُ رَسُولَ اللهِ ﷺ أُتِيَ بِفَرِيضَةٍ فِيهَا جَدٌّ فَأَعْطَاهُ ثُلُثَا أَوْ سُدُسًا فَقَالَ لَهُ عُمَرُ مَا الْفَرِيضَةُ؟ قَالَ لَا أَدْرِي فَرَكَلَهُ عُمَرُ بِقَدَمِهِ ثُمَّ قَالَ لَا دَرَيْتَ

“The Messenger of Allah ﷺ ruled concerning a grandfather who was among us, that he should receive one sixth.”

أَخْبَرَنِي مُحَمَّدُ بْنُ عَامِرٍ الْمِصِّيصِيُّ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ عِيسَى يَعْنِي ابْنَ الطَّبَّاعِ قَالَ حَدَّثَنَا هُشَيْمٌ يَعْنِي ابْنَ بَشِيرٍ عَنْ يُونُسَ يَعْنِي ابْنَ عُبَيْدٍ عَنِ الْحَسَنِ عَنْ مَعْقِلِ بْنِ يَسَارٍ قَالَ

قَضَى رَسُولُ اللهِ ﷺ فِي جَدٍّ كَانَ فِينَا بِالسُّدُسِ
