The Prophet Muhammad ﷺ said, "Whoever is capable of marriage but does not marry, then he is not from among us." – Weak Chain

أَخْبَرَنَا أَبُو عَاصِمٍ عَنِ ابْنِ جُرَيْجٍ عَنْ أَبِي الْمُغَلِّسِ عَنْ أَبِي نَجِيحٍ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ قَدَرَ عَلَى أَنْ يَنْكِحَ فَلَمْ يَنْكِحْ فَلَيْسَ مِنَّا» – إسناده ضعيف

Yaʿlá > al-Aʿmash > ʿUmārah > ʿAbd al-Raḥman b. Yazīd

It was narrated that 'Abdullah said: "The Messenger of Allah said to us: 'O young men, whoever among you can afford it, let him get married, for it is more effective in lowering the gaze and guarding chastity, and whoever cannot then he should fast, for it will be a restraint (wija') for him.'" – Sound Chain

أَخْبَرَنَا يَعْلَى حَدَّثَنَا الْأَعْمَشُ عَنْ عُمَارَةَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ يَزِيدَ قَالَ قَالَ

عَبْدُ اللَّهِ كُنَّا مَعَ رَسُولِ اللَّهِ ﷺ شَبَابًا لَيْسَ لَنَا شَيْءٌ فَقَالَ «يَا مَعْشَرَ الشَّبَابِ مَنِ اسْتَطَاعَ مِنْكُمُ الْبَاءَةَ فَلْيَتَزَوَّجْ فَإِنَّهُ أَغَضُّ لِلْبَصَرِ وَأَحْصَنُ لِلْفَرْجِ وَمَنْ لَمْ يَسْتَطِعْ فَعَلَيْهِ بِالصَّوْمِ فَإِنَّ الصَّوْمَ لَهُ وِجَاءٌ» – إسناده صحيح

Do you have a young virgin girl who reminds you of Abu Abdurrahman? So he said, "If you say that, then I have heard the Messenger of Allah ﷺ say, 'O youth, whoever among you is able to marry, let him do so, for it is more effective in guarding the gaze and preserving chastity. And whoever is not able, then let him fast, for it will be a shield for him.'" – Sound Chain

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ حَدَّثَنَا سُفْيَانُ عَنْ الْأَعْمَشِ عَنْ إِبْرَاهِيمَ عَنْ عَلْقَمَةَ عَنْ عَبْدِ اللَّهِ قَالَ لَقِيَهُ عُثْمَانُ وَأَنَا مَعَهُ فَقَالَ

لَهُ أَبَا عَبْدِ الرَّحْمَنِ هَلْ لَكَ فِي جَارِيَةٍ بِكْرٍ تُذَكِّرُكَ؟ فَقَالَ لَئِنْ قُلْتَ ذَاكَ فَقَدْ سَمِعْتُ رَسُولَ اللَّهِ ﷺ يَقُولُ «يَا مَعْشَرَ الشَّبَابِ مَنِ اسْتَطَاعَ مِنْكُمُ الْبَاءَةَ فَلْيَتَزَوَّجْ فَإِنَّهُ أَغَضُّ لِلْبَصَرِ وَأَحْصَنُ لِلْفَرْجِ وَمَنْ لَمْ يَسْتَطِعْ فَلْيَصُمْ فَإِنَّ الصَّوْمَ لَهُ وِجَاءٌ» – إسناده صحيح

Abū al-Yamān > Shuʿayb > al-Zuhrī > Saʿīd b. al-Musayyib > Saʿd b. Abū Waqqāṣ

The Prophet ﷺ prevented ʿUthman bin Mazun from that (not marrying), and had he allowed him, we would have got ourselves castrated. – Sound Chain

أَخْبَرَنَا أَبُو الْيَمَانِ أََنْبَأَنَا شُعَيْبٌ عَنْ الزُّهْرِيِّ أَخْبَرَنِي سَعِيدُ بْنُ الْمُسَيِّبِ

أَنَّهُ سَمِعَ سَعْدَ بْنَ أَبِي وَقَّاصٍ يَقُولُ «لَقَدْ رَدَّ ذَلِكَ رَسُولُ اللَّهِ ﷺ عَلَى عُثْمَانَ وَلَوْ أَجَازَ لَهُ التَّبَتُّلَ لَاخْتَصَيْنَا» – إسناده صحيح

Isḥāq > Ḥammād b. Masʿadah > al-Ashʿath b. ʿAbd al-Malik > al-Ḥasan > Saʿd b. Hishām > ʿĀʾishah

The translation of the given Arabic phrase "نَهَى رَسُولُ اللَّهِ ﷺ عَنِ التَّبَتُّلِ" into English is: "The Messenger of Allah (pbuh) forbade self-mutilation." – Sound Chain

أَخْبَرَنَا إِسْحَاقَ حَدَّثَنَا حَمَّادُ بْنُ مَسْعَدَةَ حَدَّثَنَا الْأَشْعَثُ بْنُ عَبْدِ الْمَلِكِ عَنْ الْحَسَنِ عَنْ سَعْدِ بْنِ هِشَامٍ عَنْ عَائِشَةَ قَالَتْ

«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ التَّبَتُّلِ» – إسناده صحيح

"When it came to the matter of Uthman ibn Madhun, who was known for his abstention from women, the Messenger of Allah ﷺ sent a messenger to him and said, 'O Uthman, I have not been commanded to adopt a monastic lifestyle. Have you turned away from my Sunnah?' Uthman replied, 'No, O Messenger of Allah.' The Prophet ﷺ said, 'Verily, it is from my Sunnah to pray, sleep, fast, give charity, get married, and divorce. Whoever turns away from my Sunnah is not of me, O Uthman. Indeed, your family has rights over you, and you have rights over yourself.' Saad said, 'By Allah, all the men among the Muslims were united in their acknowledgement that the Messenger of Allah ﷺ showed special preference to Uthman regarding his choice to abstain from women.'" – Sound Chain

حَدَّثَنَا مُحَمَّدُ بْنُ يَزِيدَ الْحِزَامِيُّ حَدَّثَنَا يُونُسُ بْنُ بُكَيْرٍ حَدَّثَنِي ابْنُ إِسْحَاقَ حَدَّثَنِي الزُّهْرِيُّ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ قَالَ

لَمَّا كَانَ مِنْ أَمْرِ عُثْمَانَ بْنِ مَظْعُونٍ الَّذِي كَانَ مِنْ تَرْكِ النِّسَاءِ بَعَثَ إِلَيْهِ رَسُولُ اللَّهِ ﷺ فَقَالَ «يَا عُثْمَانُ إِنِّي لَمْ أُومَرْ بِالرَّهْبَانِيَّةِ أَرَغِبْتَ عَنْ سُنَّتِي؟» قَالَ لَا يَا رَسُولَ اللَّهِ قَالَ «إِنَّ مِنْ سُنَّتِي أَنْ أُصَلِّيَ وَأَنَامَ وَأَصُومَ وَأَطْعَمَ وَأَنْكِحَ وَأُطَلِّقَ فَمَنْ رَغِبَ عَنْ سُنَّتِي فَلَيْسَ مِنِّي يَا عُثْمَانُ إِنَّ لِأَهْلِكَ عَلَيْكَ حَقًّا وَلِنَفْسِكَ عَلَيْكَ حَقًّا» قَالَ سَعْدٌ فَوَاللَّهِ لَقَدْ كَانَ أَجْمَعَ رِجَالٌ مِنَ الْمُسْلِمِينَ عَلَى أَنَّ رَسُولَ اللَّهِ ﷺ إِنْ هُوَ أَقَرَّ عُثْمَانَ عَلَى مَا هُوَ عَلَيْهِ أَنْ نَخْتَصِيَ فَنَتَبَتَّلَ – إسناده صحيح

Ṣadaqah b. al-Faḍl > Yaḥyá b. Saʿīd > ʿUbaydullāh > Saʿīd b. Abū Saʿīd from his father > Abū Hurayrah

for her property, her ranks, her beauty and her religiosity. So get the one who is religious and prosper (lit. may your hands cleave to the dust).”

حَدَّثَنَا صَدَقَةُ بْنُ الْفَضْلِ أَنْبَأَنَا يَحْيَى بْنُ سَعِيدٍ عَنْ عُبَيْدِ اللَّهِ عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ

عَنِ النَّبِيِّ ﷺ قَالَ تُنْكَحُ النِّسَاءُ لِأَرْبَعٍ لِلدِّينِ وَالْجَمَالِ وَالْمَالِ وَالْحَسَبِ فَعَلَيْكَ بِذَاتِ الدِّينِ تَرِبَتْ يَدَاكَ

Muḥammad b. ʿUyaynah > ʿAlī b. Mushir > ʿAbd al-Malik > ʿAṭāʾ b. Abū Rabāḥ > Jābir

The tradition mentioned above has also been transmitted by Rukanah bin Yazid from the Prophet ﷺ through a different chain of narrators. – Sound Chain

أَخْبَرَنَا مُحَمَّدُ بْنُ عُيَيْنَةَ عَنْ عَلِيِّ بْنِ مُسْهِرٍ عَنْ عَبْدِ الْمَلِكِ عَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ عَنْ جَابِرٍ

عَنِ النَّبِيِّ ﷺ بِهَذَا الْحَدِيثِ – إسناده صحيح

Qabīṣah > Sufyān > ʿĀṣim al-Aḥwal > Bakr b. ʿAbdullāh al-Muzanī > al-Mughīrah b. Shuʿbah > Khaṭab Āmraʾah from al-Anṣār

His messenger ﷺ said to him, "Go and look at her, as it is more appropriate for reconciliation to take place between you." – Sound Chain

أَخْبَرَنَا قَبِيصَةُ حَدَّثَنَا سُفْيَانُ عَنْ عَاصِمٍ الْأَحْوَلِ عَنْ بَكْرِ بْنِ عَبْدِ اللَّهِ الْمُزَنِيِّ عَنْ الْمُغِيرَةِ بْنِ شُعْبَةَ أَنَّهُ خَطَبَ امْرَأَةً مِنَ الْأَنْصَارِ فَقَالَ

لَهُ رَسُولُ اللَّهِ ﷺ «اذْهَبْ فَانْظُرْ إِلَيْهَا فَإِنَّهُ أَجْدَرُ أَنْ يُؤْدَمَ بَيْنَكُمَا» – إسناده صحيح

Muḥammad b. Kathīr al-ʿAbdī al-Baṣrī > Sufyān > Yūnus > al-Ḥasan > Samiʿtuh

"Do not say that, for the Messenger of Allah ﷺ forbade us from doing so and commanded us to say 'May Allah bless you and grant you blessings'."

أَخْبَرَنَا مُحَمَّدُ بْنُ كَثِيرٍ الْعَبْدِيُّ الْبَصْرِيُّ أَخْبَرَنَا سُفْيَانُ عَنْ يُونُسَ عَنْ الْحَسَنِ قَالَ سَمِعْتُهُ يَقُولُ قَدِمَ عَقِيلُ بْنُ أَبِي طَالِبٍ الْبَصْرَةَ فَتَزَوَّجَ امْرَأَةً مِنْ بَنِي جُشَمٍ فَقَالُوا لَهُ بِالرِّفَاءِ وَالْبَنِينَ فَقَالَ

لَا تَقُولُوا ذَلِكَ إِنَّ رَسُولَ اللَّهِ ﷺ نَهَانَا عَنْ ذَلِكَ وَأَمَرَنَا أَنْ نَقُولَ «بَارَكَ اللَّهُ لَكَ وَبَارَكَ عَلَيْكَ»

Nuʿaym b. Ḥammād > ʿAbd al-ʿAzīz > Suhayl from his father > Abū Hurayrah

When the Prophet ﷺ congratulated a man on his marriage, he said: May Allah bless for you, and may He bless on you, and combine both of you in good (works). – Good Chain

حَدَّثَنَا نُعَيْمُ بْنُ حَمَّادٍ حَدَّثَنَا عَبْدُ الْعَزِيزِ عَنْ سُهَيْلٍ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ

عَنِ النَّبِيِّ ﷺ أَنَّهُ كَانَ إِذَا رَفَّأَ لِإِنْسَانٍ قَالَ «بَارَكَ اللَّهُ لَكَ وَبَارَكَ عَلَيْكَ وَجَمَعَ بَيْنَكُمَا فِي خَيْرٍ» – إسناده حسن

Abū al-Walīd al-Ṭayālisī > Shuʿbah > Suhayl b. Abū Ṣāliḥ from his father > Abū Hurayrah

About the Prophet ﷺ who said, "A man should not propose marriage to his brother's fiancée." – Sound Chain

أَخْبَرَنَا أَبُو الْوَلِيدِ الطَّيَالِسِيُّ حَدَّثَنَا شُعْبَةُ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ عَنْ أَبِيهِ عَنْ أَبِي هُرَيْرَةَ

عَنِ النَّبِيِّ ﷺ أَنَّهُ «نَهَى عَنْ أَنْ يَخْطُبَ الرَّجُلُ عَلَى خِطْبَةِ أَخِيهِ» – إسناده صحيح

ʿAbdullāh b. Saʿīd > ʿUqbah b. Khālid > ʿUbaydullāh > Nāfiʿ > Ibn ʿUmar

The Prophet ﷺ said: One of you must not ask a woman in marriage when his brother has done so already, and one of you must not sell (his own goods) when his brother has already sold (his goods) except with his permission. – Sound Chain

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ سَعِيدٍ حَدَّثَنَا عُقْبَةُ بْنُ خَالِدٍ عَنْ عُبَيْدِ اللَّهِ قَالَ حَدَّثَنِي نَافِعٌ عَنْ ابْنِ عُمَرَ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَا يَخْطُبُ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ وَلَا يَبِيعُ عَلَى بَيْعِ أَخِيهِ حَتَّى يَأْذَنَ لَهُ» – إسناده صحيح

Yazīd b. Hārūn > Muḥammad b. ʿAmr > Abū Salamah > Fāṭimah b. Qays > And Katabah Minhā Kitāb

She was under the authority of a man from the Quraysh tribe of Banu Makhzum, but he divorced her abruptly. She then sent a message to her family seeking financial support, but they informed her that they had no provision for her. The Messenger of Allah ﷺ was informed of this, and he said, "You have no financial support, but you have an 'iddah (waiting period). Move to the house of Umm Sharik and do not burden us with your presence." Then he said, "Umm Sharik is a woman who is visited by her brothers from the Muhajirin, but move to the house of Ibn Umm Maktum, for he is a blind man. If you take off your clothes, he will not see anything, and do not burden us with your presence." So she went to the house of Ibn Umm Maktum, and when she arrived, she remembered that Mu'awiyah and Abu Jahm had proposed to her. The Messenger of Allah ﷺ said, "As for Mu'awiyah, he is a man without wealth, and as for Abu Jahm, he does not take his cane off his shoulder. So where do you stand with regard to Usamah?" Her family seemed to dislike this, so she said, "By Allah, I will not marry anyone except the one whom the Messenger of Allah ﷺ has mentioned." Therefore, she married Usamah. Muhammad ibn Amr said that Muhammad ibn Ibrahim said, "O Fatimah, fear Allah, for you have known what this meant."

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ أََنْبَأَنَا مُحَمَّدُ بْنُ عَمْرٍو عَنْ أَبِي سَلَمَةَ عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ أَنَّهَا حَدَّثَتْهُ وَكَتَبَهُ مِنْهَا كِتَابًا

أَنَّهَا كَانَتْ تَحْتَ رَجُلٍ مِنْ قُرَيْشٍ مِنْ بَنِي مَخْزُومٍ فَطَلَّقَهَا الْبَتَّةَ فَأَرْسَلَتْ إِلَى أَهْلِهِ تَبْتَغِي مِنْهُمُ النَّفَقَةَ فَقَالُوا لَيْسَ لَكِ نَفَقَةٌ فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَقَالَ «لَيْسَ لَكِ نَفَقَةٌ وَعَلَيْكِ الْعِدَّةُ وَانْتَقِلِي إِلَى بَيْتِ أُمِّ شَرِيكٍ وَلَا تُفَوِّتِينَا بِنَفْسِكِ» ثُمَّ قَالَ «إِنَّ أُمَّ شَرِيكٍ امْرَأَةٌ يَدْخُلُ عَلَيْهَا إِخْوَانُهَا مِنَ الْمُهَاجِرِينَ وَلَكِنِ انْتَقِلِي إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى إِنْ وَضَعْتِ ثِيَابَكِ لَمْ يَرَ شَيْئًا وَلَا تُفَوِّتِينَا بِنَفْسِكِ» فَانْطَلَقَتْ إِلَى بَيْتِ ابْنِ أُمِّ مَكْتُومٍ فَلَمَّا حَلَّتْ ذَكَرَتْ أَنَّ مُعَاوِيَةَ وَأَبَا جَهْمٍ خَطَبَاهَا فَقَالَ رَسُولُ اللَّهِ ﷺ «أَمَّا مُعَاوِيَةُ فَرَجُلٌ لَا مَالَ لَهُ وَأَمَّا أَبُو جَهْمٍ فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ فَأَيْنَ أَنْتَ مِنْ أُسَامَةَ؟» فَكَأَنَّ أَهْلَهَا كَرِهُوا ذَلِكَ فَقَالَتْ وَاللَّهِ لَا أَنْكِحُ إِلَّا الَّذِي قَالَ رَسُولُ اللَّهِ ﷺ فَنَكَحَتْ أُسَامَةَ قَالَ مُحَمَّدُ بْنُ عَمْرٍو قَالَ مُحَمَّدُ بْنُ إِبْرَاهِيمَ يَا فَاطِمَةُ اتَّقِي اللَّهَ فَقَدْ عَلِمْتِ فِي أَيِّ شَيْءٍ كَانَ هَذَا

"The Messenger of Allah prohibited that a woman be married along with her paternal aunt, or the paternal aunt along with her brother's daughter, or a woman with her maternal aunt, or the maternal aunt along with her sister's daughter, and the younger is not to be married with the older, nor the older with the younger." – Sound Chain

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ حَدَّثَنَا دَاوُدُ يَعْنِي ابْنَ أَبِي هِنْدٍ حَدَّثَنَا عَامِرٌ حَدَّثَنَا أَبُو هُرَيْرَةَ

أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى أَنْ تُنْكَحَ الْمَرْأَةُ عَلَى عَمَّتِهَا وَالْعَمَّةُ عَلَى ابْنَةِ أَخِيهَا أَوِ الْمَرْأَةُ عَلَى خَالَتِهَا أَوِ الْخَالَةُ عَلَى بِنْتِ أُخْتِهَا وَلَا تُنْكَحُ الصُّغْرَى عَلَى الْكُبْرَى وَلَا الْكُبْرَى عَلَى الصُّغْرَى» – إسناده صحيح

ʿUbaydullāh b. ʿAbd al-Majīd > Mālik > Abū al-Zinād > al-Aʿraj > Abū Hurayrah

"The Messenger of Allah said: '(A man should not be married to) a woman and her paternal aunt nor to a woman and her maternal aunt at the same time.'" – Sound Chain

حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ عَبْدِ الْمَجِيدِ حَدَّثَنَا مَالِكٌ عَنْ أَبِي الزِّنَادِ عَنْ الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ

أَنَّ رَسُولَ اللَّهِ ﷺ «نَهَى أَنْ يُجْمَعَ بَيْنَ الْمَرْأَةِ وَعَمَّتِهَا وَالْمَرْأَةِ وَخَالَتِهَا» – إسناده صحيح

Khālid b. Makhlad > Mālik > Nāfiʿ > Ibn ʿUmar

"The Messenger of Allah ﷺ prohibited 'shighar'. Malik said, 'Shighar' is when a man gives his daughter in marriage to another man, while that man gives his daughter in marriage to the first man, without any dowry. Abu Muhammad was asked, 'Do you consider marriage between them valid?' He said, 'I do not approve of it.'" – Strong Chain

حَدَّثَنَا خَالِدُ بْنُ مَخْلَدٍ حَدَّثَنَا مَالِكٌ عَنْ نَافِعٍ عَنْ ابْنِ عُمَرَ قَالَ

«نَهَى رَسُولُ اللَّهِ ﷺ عَنِ الشِّغَارِ» قَالَ مَالِكٌ وَالشِّغَارُ أَنْ يُزَوِّجَ الرَّجُلُ الْآخَرَ ابْنَتَهُ عَلَى أَنْ يُزَوِّجَهُ الْآخَرُ ابْنَتَهُ بِغَيْرِ صَدَاقٍ قِيلَ لِأَبِي مُحَمَّدٍ تَرَى بَيْنَهُمَا نِكَاحًا قَالَ لَا يُعْجِبُنِي – إسناده قوي

Abū ʿĀṣim > Ibrāhīm b. ʿUmar b. Kaysān from his father > Wahbb. Abū Mughīth > Asmāʾ b. Abū Bakr > ʿĀʾishah

On the authority of the Prophet ﷺ, he said, "Marry the righteous men and the righteous women." Abu Muhammad said, "And it was revealed to me from the Hadith, so whatever follows after them is good." – Good Chain

أَخْبَرَنَا أَبُو عَاصِمٍ عَنْ إِبْرَاهِيمَ بْنِ عُمَرَ بْنِ كَيْسَانَ عَنْ أَبِيهِ عَنْ وَهْبِ بْنِ أَبِي مُغِيثٍ حَدَّثَتْنِي أَسْمَاءُ بِنْتُ أَبِي بَكْرٍ عَنْ عَائِشَةَ

عَنِ النَّبِيِّ ﷺ قَالَ «أَنْكِحُوا الصَّالِحِينَ وَالصَّالِحَاتِ» قَالَ أَبُو مُحَمَّد «وَسَقَطَ عَلَيَّ مِنَ الْحَدِيثِ فَمَا تَبِعَهُمْ بَعْدُ فَحَسَنٌ» – إسناده حسن

Mālik b. Ismāʿīl > Isrāʾīl > Abū Isḥāq > Abū Burdah from his father

the Messenger of Allah said: “There is no marriage except with a guardian.” – Sound Chain

أَخْبَرَنَا مَالِكُ بْنُ إِسْمَاعِيلَ حَدَّثَنَا إِسْرَائِيلُ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي بُرْدَةَ عَنْ أَبِيهِ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ» – إسناده صحيح

From the Prophet ﷺ who said, "There is no marriage except with a guardian." – Weak Chain

حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ أَنْبَأَنَا شَرِيكٌ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي بُرْدَةَ عَنْ أَبِي مُوسَى

عَنِ النَّبِيِّ ﷺ قَالَ «لَا نِكَاحَ إِلَّا بِوَلِيٍّ» – إسناده ضعيف

Abū ʿĀṣim > Ibn Jurayj > Sulaymān b. Mūsá > al-Zuhrī > ʿUrwah > ʿĀʾishah

The Prophet ﷺ said: "Any woman who is married without the permission of her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid. If they dispute, Abu Asim said: and he said it once: if they argue, then the ruler is the guardian of the one who has no guardian. If he (the ruler) decides in her favor, then she has the dowry for what he has permitted from her private parts." Abu Asim said: He (the Prophet) repeated this statement forty-six times. – Good Chain

حَدَّثَنَا أَبُو عَاصِمٍ عَنْ ابْنِ جُرَيْجٍ عَنْ سُلَيْمَانَ بْنِ مُوسَى عَنْ الزُّهْرِيِّ عَنْ عُرْوَةَ عَنْ عَائِشَةَ

عَنِ النَّبِيِّ ﷺ قَالَ أَيُّمَا امْرَأَةٍ نُكِحَتْ بِغَيْرِ إِذْنِ وَلِيِّهَا فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَنِكَاحُهَا بَاطِلٌ فَإِنِ اشْتَجَرُوا قَالَ أَبُو عَاصِمٍ وَقَالَ مَرَّةً فَإِنْ تَشَاجَرُوا فَالسُّلْطَانُ وَلِيُّ مَنْ لَا وَلِيَّ لَهُ فَإِنْ أَصَابَهَا فَلَهَا الْمَهْرُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا قَالَ أَبُو عَاصِمٍ أَمْلَاهُ عَلَيَّ سَنَةَ سِتٍّ وَأَرْبَعِينَ وَمِائَةٍ – إسناده حسن

"The Messenger of Allah said: 'An orphan girl should be consulted with regard to marriage, and if she remains silent, that is her permission. If she refuses then she is not to be forced.'" – Sound Chain

أَخْبَرَنَا أَبُو نُعَيْمٍ حَدَّثَنَا يُونُسُ بْنُ أَبِي إِسْحَاقَ حَدَّثَنِي أَبُو بُرْدَةَ بْنُ أَبِي مُوسَى عَنْ أَبِي مُوسَى قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَقَدْ أَذِنَتْ وَإِنْ أَبَتْ لَمْ تُكْرَهْ» – إسناده صحيح

the Messenger of Allah said: “A previously-married woman should not be married until she is consulted, and a virgin should not be married until her consent is sought, and her consent is her silence.” – Sound Chain

أَخْبَرَنَا أَبُو الْمُغِيرَةِ حَدَّثَنَا الْأَوْزَاعِيُّ حَدَّثَنِي يَحْيَى عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «لَا تُنْكَحُ الثَّيِّبُ حَتَّى تُسْتَأْمَرَ وَلَا تُنْكَحُ الْبِكْرُ حَتَّى تُسْتَأْذَنَ وَإِذْنُهَا الصُّمُوتُ» – إسناده صحيح

عَنْ رَسُولِ اللَّهِ ﷺ بِهَذَا الْحَدِيثِ – إسناده صحيح

Ibn ‘Abbas reported the Apostle of Allaah ﷺ as saying “A woman without a husband has more right to her person than her guardian and a virgin’s permission must be asked, her permission being her silence. These are the words of Al Qa’nabi. – Strong Chain

حَدَّثَنَا خَالِدُ بْنُ مَخْلَدٍ حَدَّثَنَا مَالِكٌ عَنْ عَبْدِ اللَّهِ بْنِ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرِ بْنِ مُطْعِمٍ عَنْ ابْنِ عَبَّاسٍ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «الْأَيِّمُ أَحَقُّ بِنَفْسِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْذَنُ فِي نَفْسِهَا وَإِذْنُهَا صُمَاتُهَا» – إسناده قوي

Isḥāq b. ʿĪsá > Mālik Awwal Shayʾ Saʾaltuh ʿAnh > ʿAbdullāh b. al-Faḍl > Nāfiʿ b. Jubayr > Ibn ʿAbbās

The Messenger of Allah, peace be upon him, said: "The permission of a virgin is sought, and her silence is considered as her permission." – Sound Chain

حَدَّثَنَا إِسْحَاقُ بْنُ عِيسَى حَدَّثَنِي مَالِكٌ أَوَّلُ شَيْءٍ سَأَلْتُهُ عَنْهُ قَالَ حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْفَضْلِ عَنْ نَافِعِ بْنِ جُبَيْرٍ عَنْ ابْنِ عَبَّاسٍ قَالَ

قَالَ رَسُولُ اللَّهِ ﷺ «تُسْتَأْذَنُ الْبِكْرُ وَإِذْنُهَا صُمَاتُهَا» – إسناده صحيح

أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ عَبْدِ الْمَجِيدِ حَدَّثَنِي عُبَيْدُ اللَّهِ بْنُ عَبْدِ الرَّحْمَنِ بْنِ مَوْهَبٍ أَخْبَرَنَا نَافِعُ بْنُ جُبَيْرِ بْنِ مُطْعِمٍ عَنْ ابْنِ عَبَّاسٍ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «الْأَيِّمُ أَمْلَكُ بِأَمْرِهَا مِنْ وَلِيِّهَا وَالْبِكْرُ تُسْتَأْمَرُ فِي نَفْسِهَا وَصَمْتُهَا إِقْرَارُهَا» – إسناده حسن

Yazīd b. Hārūn > Yaḥyá b. Saʿīd > al-Qāsim b. Muḥammad > ʿAbd al-Raḥman b. Yazīd And Mujammiʿ b. Yazīd al-Anṣāriyyayn Ḥaddathāh

that a man among them who was called Khidam arranged a marriage for his daughter, and she did not like the marriage arranged by her father. She went to the Messenger of Allah and told him about that, and he annulled the marriage arranged by her father. Then she married Abu Lubabah bin Abdul-Mundhir. – Sound Chain

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ أَنْبَأَنَا يَحْيَى بْنُ سَعِيدٍ أَنَّهُ سَمِعَ الْقَاسِمَ بْنَ مُحَمَّدٍ أَنَّهُ سَمِعَ عَبْدَ الرَّحْمَنِ بْنَ يَزِيدَ وَمُجَمِّعَ بْنَ يَزِيدَ الْأَنْصَارِيَّيْنِ حَدَّثَاهُ

أَنَّ رَجُلًا مِنْهُمْ مِنَ الْأَنْصَارِ يُدْعَى خِذَامًا «أَنْكَحَ بِنْتًا لَهُ فَكَرِهَتْ نِكَاحَ أَبِيهَا» فَأَتَتْ رَسُولَ اللَّهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَرَدَّ عَنْهَا نِكَاحَ أَبِيهَا فَنَكَحَتْ أَبَا لُبَابَةَ بْنَ عَبْدِ الْمُنْذِرِ فَذَكَرَ يَحْيَى أَنَّهُ بَلَغَهُ أَنَّهَا كَانَتْ ثَيِّبًا – إسناده صحيح

Khālid b. Makhlad > Mālik > ʿAbd al-Raḥman b. al-Qāsim from his father > ʿAbd al-Raḥman Wumujammiʿ Āb.ay Yazīd Ibn a neighboriyah

It was narrated from Khansa' bint Khidham that her father married her off when she had been previously married, and she was unwilling. She went to the Messenger of Allah and he annulled the marriage. – Strong Chain

أَخْبَرَنَا خَالِدُ بْنُ مَخْلَدٍ حَدَّثَنَا مَالِكٌ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ عَنْ أَبِيهِ عَنْ عَبْدِ الرَّحْمَنِ وُمُجَمِّعٍ ابْنَيْ يَزِيدَ ابْنِ جَارِيَةَ

أَنَّ خَنْسَاءَ بِنْتَ خِذَامٍ زَوَّجَهَا أَبُوهَا وَهِيَ ثَيِّبٌ فَكَرِهَتْ ذَلِكَ فَأَتَتْ رَسُولَ اللَّهِ ﷺ «فَرَدَّ نِكَاحَهَا» – إسناده قوي

Yazīd b. Hārūn > Saʿīd > Qatādah > al-Ḥasan > ʿUqbah b. ʿĀmir or Samurah b. Jundub

The Prophet ﷺ said: Any woman who is married by two guardians (to two different men) belongs to the first woman who is married by two guardians (to two different men) belongs to the first of them and anything sold by a man to two persons belongs to the first of them. – Weak Chain

أَخْبَرَنَا يَزِيدُ بْنُ هَارُونَ أََنْبَأَنَا سَعِيدٌ عَنْ قَتَادَةَ عَنْ الْحَسَنِ عَنْ عُقْبَةَ بْنِ عَامِرٍ أَوْ سَمُرَةَ بْنِ جُنْدُبٍ

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ لَهَا فَهِيَ لِلْأَوَّلِ مِنْهُمَا وَأَيُّمَا رَجُلٍ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَهُوَ لِلْأَوَّلِ مِنْهُمَا» – إسناده ضعيف
