مَا وُجِدَ مِنَ اللُّقَطَةِ فِي الْقَرْيَةِ غَيْرِ الْعَامِرَةِ، وَلَا الْمَسْكُونَةِ

A man came to the Messenger of Allah ﷺ and said, "How should we act if we find something on the road or in an inhabited town?" He replied, "Announce it for a year, and if someone claims it, then give it to him. Otherwise, it is yours." The man asked, "What if the owner comes to claim it after a long time?" The Messenger of Allah ﷺ said, "Give it to him, but if it was found on the road or in an inhabited town, then it should be shared equally among the people."
الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ عَنِ ابْنِ وَهْبٍ قَالَ أَخْبَرَنِي عَمْرُو بْنُ الْحَارِثِ وَهِشَامُ بْنُ سَعْدٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ
أَنَّ رَجُلًا أَتَى رَسُولَ اللهِ ﷺ فَقَالَ كَيْفَ فِيمَا وُجِدَ فِي الطَّرِيقِ الْمِيتَاءِ أَوْ فِي الْقَرْيَةِ الْمَسْكُونَةِ؟ قَالَ «عَرِّفْ سَنَةً فَإِنْ جَاءَ بَاغِيَةٌ فَادْفَعْهُ إِلَيْهِ وَإِلَّا فَشَأْنُكَ بِهِ» قَالَ «فَإِنْ جَاءَ طَالِبُهَا يَوْمًا مِنَ الدَّهْرِ فَأَدِّهَا إِلَيْهِ وَمَا كَانَ فِي الطَّرِيقِ غَيْرِ الْمِيتَاءِ وَفِي الْقَرْيَةِ غَيْرِ الْمَسْكُونَةِ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ»

"The Messenger of Allah was asked about Al-Luqath.[2] He said: "That which is found on a much-traveled road or in an inhabited village, announce it for a year. If its owner comes (and takes it, well and good), otherwise it is yours. That which was not found on a much-traveled road or in an inhabited village is subject to the Khuns, as is Rikaz."'[1]
أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ قَالَ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ عُبَيْدِ اللهِ بْنِ الْأَخْنَسِ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اللُّقَطَةِ فَقَالَ «مَا كَانَ فِي طَرِيقٍ مَأْتِيٍّ أَوْ فِي قَرْيَةٍ عَامِرَةٍ فَعَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَلَكَ وَمَا لَمْ يَكُنْ فِي طَرِيقٍ مَأْتِيٍّ أَوْ فِي قَرْيَةٍ عَامِرَةٍ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ» خَالَفَهُ مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَنْصَارِيُّ

I said, "O Messenger of Allah, advise me regarding the found property." He said, "If you find it on a dead-end road or in an inhabited village, announce it for a year. If you do not find its owner, then you may keep it." And he narrated the hadith.
أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ بْنِ إِبْرَاهِيمَ عَنِ الْأَنْصَارِيِّ عَنْ عُبَيْدِ اللهِ بْنِ الْأَخْنَسِ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنْ أَبِي ثَعْلَبَةَ قَالَ
قُلْتُ يَا رَسُولَ اللهِ أَفْتِنِي فِي اللُّقَطَةِ قَالَ «مَا وَجَدْتَهُ فِي طَرِيقٍ مَيْتَاءٍ أَوْ فِي قَرْيَةٍ عَامِرَةٍ فَعَرِّفْهُ سَنَةً إِنْ لَمْ تَجِدْ صَاحِبَهُ» وَسَاقَ الْحَدِيثَ
