About a man who divorced his wife three times, and then his brother married her without any conspiracy from him in order to make her permissible for his brother. Does she become permissible for the first husband? He said, "No, marriage is a desire. We used to consider this as a form of licentiousness during the time of the Prophet Muhammad ﷺ." – Sound Chain per Bukhārī and Muslim
حَدَّثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ ثنا مُحَمَّدُ بْنُ إِسْحَاقَ الصَّغَانِيُّ ثنا سَعِيدُ بْنُ أَبِي مَرْيَمَ ثنا أَبُو غَسَّانَ مُحَمَّدُ بْنُ مُطَرِّفٍ الْمَدَنِيُّ عَنْ عُمَرَ بْنِ نَافِعٍ عَنْ أَبِيهِ أَنَّهُ قَالَ جَاءَ رَجُلٌ إِلَى ابْنِ عُمَرَ فَسَأَلَهُ
عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا فَتَزَوَّجَهَا أَخٌ لَهُ مِنْ غَيْرِ مُؤَامَرَةٍ مِنْهُ لِيُحِلَّهَا لِأَخِيهِ هَلْ تَحِلُّ لِلْأَوَّلِ؟ قَالَ «لَا الْإِنْكَاحُ رَغْبَةٌ كُنَّا نَعُدُّ هَذَا سِفَاحًا عَلَى عَهْدِ رَسُولِ اللَّهِ ﷺ» هَذَا حَدِيثٌ صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخَرِّجَاهُ على شرط البخاري ومسلم – على شرط البخاري ومسلم
